FRESH BRAZILIAN JIU JITSU WAIVER AND RELEASE OF LIABILITY

Activity Description:

I, the undersigned, wish to participate in Graston Therapy, Stick Mobility, Personal Training sessions, and Martial Arts classes (hereinafter referred to as "Activities") provided by Fresh Brazilian Jiu Jitsu (hereinafter referred to as "Provider").

Acknowledgment of Risks:

I understand that participation in the Activities involves inherent risks, including but not limited to physical injury, muscle strains, and other health-related issues. I acknowledge that I have been informed of these risks and voluntarily choose to participate in the Activities.

Medical Clearance:

I affirm that I am in good health and have no medical conditions that would prevent my participation in the Activities. I have consulted with a physician regarding my ability to engage in physical activities, and I have received clearance to participate.

Release of Liability:

In consideration of being allowed to participate in the Activities, I hereby release, waive, and discharge Fresh Brazilian Jiu Jitsu, its owners, employees, agents, and representatives from any and all claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in the Activities, whether caused by the negligence of the Provider or otherwise.

Indemnification:

I agree to indemnify and hold harmless Fresh Brazilian Jiu Jitsu from any loss, liability, damage, or costs, including court costs and attorney fees, that may incur due to my participation in the Activities, whether caused by negligence or otherwise.

Photography and Media Release:

I grant permission to Fresh Brazilian Jiu Jitsu to use photographs, videos, or other media taken during the Activities for promotional purposes without compensation to me.

Assumption of Risk:

I represent that I am in good physical condition and can use the facilities of Fresh Brazilian Jiu Jitsu. I acknowledge that I am fully aware of the risks and hazards inherent in the practice of martial arts and fitness activities and hereby assume all risks of loss, damage, injury, or COVID-19 (including death) that may be sustained by me or to my property.

Acceptance of Responsibility:

I accept full responsibility for the use of, or participation in, any classes, services, equipment, demonstrations, or events, whatsoever owned, operated, or sponsored by Fresh Brazilian Jiu Jitsu, whether on-site or off-site, and hereby release and agree to hold harmless its owners, officers, directors, members, employees, representatives, and agents from any loss, claim, injury, damage, or liability sustained or incurred by me resulting therefrom.

Binding Effect:

This release shall be binding upon the heirs, distributes, next of kin, executor, and administrator of each undersigned. In signing this Agreement, I acknowledge and represent that I have read this release, understand it, and signed it voluntarily.

Privacy Release:

I, {name}, do hereby grant Fresh Brazilian Jiu Jitsu and any assigns, licensees, and legal representatives the irrevocable right to use my name (or any fictional name), picture, portrait, or photograph in all forms and media in all manners, including composite or distorted representations, for advertising, trade, or any other lawful purposes. I waive any right to inspect or approve the finished version(s), including written copy that may be created in connection. I am of lawful age and/or the legal guardian of those named above. I have read this release and am fully familiar with its contents.

I have read this waiver and release of liability, fully understand its terms, and understand that I am giving up substantial rights, including the right to sue. I acknowledge that I am signing this waiver freely and voluntarily.
